PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 30 July 1985, the applicant was found guilty by a special court-martial of violating a lawful general regulation, by possessing and using the ration control plate and ID card of another service member (850519); and, wrongfully and willfully impersonating a commissioned officer of the Army by showing the Ration Control Plate and Armed Forces ID card of CPT (850519). He was sentenced to a Bad Conduct Discharge, and reduction to E1. On 3 September 1985, the sentence was approved. The record of trial was forwarded to The Judge Advocate General of The Army for review by the Court of Military Review. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty). His DD Form 214 indicates that he was discharged with a bad conduct discharge under the provisions of Chapter 3, AR 635-200 by reason of court-martial, other. DA, HQ, US Army Field Artillery Center, Ft Sill, Oklahoma, Order 159-127 discharged the applicant from the Regular Army effective dated 16 June 1987.

         b. On 16 June 1987, the applicant was discharged. At the time of discharge, the applicant had completed 3 years, 5 months, and 21 days of active military service and accrued 1 day of lost time in the period under review and had a total of 8 years, 7 months, and 24 days of active military service.

Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 3, Section IV, establishes policy and procedures for separating members with a dishonorable or bad conduct discharge; and provides that a soldier will be given a bad conduct discharge pursuant only to an approved sentence of a general or special court-martial; and that the appellate review must be completed and the affirmed sentence ordered duly executed.
